Questions and Answers about Davis-Bacon Act compliance

The American Recovery and Reinvestment Act requires compliance with the Davis-Bacon Act and related acts, which mandate that prevailing wages must be paid on public works projects using ARRA funds. It is the responsibility of entities receiving ARRA funds and their contractors to complete and submit for approval a Conformance Request if skills or job classifications are needed for construction, but not listed on the approved Department of Labor Wage Determination.


A guidance document on the preparation of a 1444 Conformance Request was developed by the Texas Water Development Board and its consultant AECOM, and two informational webinars were conducted during January 2011.
