Draft DWSRF IUP: Amended Version Following Public Comment Period
On Friday, July 10, at 1:30pm, Texas Water Development Board (TWDB) conducted a public hearing for the Draft American Recovery and Reinvestment Act of 2009 (ARRA) Drinking Water State Revolving Fund (DWSRF) Intended Use Plan (IUP). The hearing was a component of a 30 day public comment period which concluded at 5:00pm, Monday, July 13. It is estimated that over 100 persons attended the hearing; 29 presented public comment. In total, approximately 70 comments were received throughout the comment period.
Based on qualifying information received from applicants during the public comment period that clarified a project’s description, including disadvantaged community status or qualifications as a “green” project, revisions have been made to the Draft DWSRF IUP. EPA Awards ARRA DWSRF Grant
The United States Environmental Protection Agency (EPA) announced today that they have awarded the Texas Water Development Board (TWDB) over $160 million from the American Recovery and Reinvestment Act (ARRA) of 2009 for projects to be funded through the Drinking Water State Revolving Fund (DWSRF).
TWDB is currently taking public comments on the Draft ARRA DWSRF Intended Use Plan. A public hearing will be held on Friday, July 10, 2009 at 1:30 p.m., and the public comment period ends at 5:00 p.m. on Monday, July 13, 2009.
Following review of all public comments, a Final ARRA DWSRF Intended Use Plan will be submitted for adoption at the regularly scheduled TWDB meeting on Thursday, July 16, 2009 at 11:00 a.m. Shortly thereafter formal invitations will be sent to those entities on the Intended Use Plan designated as eligible for ARRA funding assistance.

ARRA DWSRF Draft IUP: Public Hearing Notice Posted
Public Hearing Notice for Drinking Water State Revolving Fund Intended Use Plan for American Recovery and Reinvestment Act of 2009
The Texas Water Development Board (Board) will conduct a public hearing on the draft American Recovery and Reinvestment Act of 2009 (ARRA) Drinking Water State Revolving Fund (DWSRF) Intended Use Plan (IUP) to implement funding under the ARRA special DWSRF capitalization grant. The hearing will begin at 1:30 p.m. on July 10, 2009, in Room 170 of the Stephen F. Austin Building at 1700 N. Congress Ave., Austin, Texas 78701. Public access to the Stephen F. Austin Building is located at the Congress Avenue (east) entrance of the building.

The ARRA DWSRF IUP a list of water projects in prioritized order which will be considered for funding in Fiscal Year 2010 through the DWSRF loan program. The draft ARRA DWSRF IUP has been prepared pursuant to rules adopted by the Texas Water Development Board in 31 Texas Administrative Code Chapter 371. Please note that these rules have been waived or modified by the TWDB in certain respects in order to comply with special requirements for the ARRA DWSRF capitalization grant. The ARRA DWSRF funds must be used to fund projects that are either under construction or fully committed to construction contracts no later than February 17, 2010. Accordingly, the projects are prioritized on the basis of readiness to proceed to construction before that date. ARRA also requires that 20% of the available funds are set aside for “green” projects and 50% for deep subsidization of projects which the Board has reserved for disadvantaged communities. Interested persons are encouraged to attend the hearing and to present relevant and material comments concerning the draft ARRA DWSRF IUP. The Board also will receive information from applicants in addition to that previously provided in order to supplement or clarify a project's readiness to proceed, disadvantaged community status, or qualifications as a “green” project. However, the Board will not consider any changes or modifications to the scope of work for any project.

Comments and supplemental information provided outside of electronic submission at the address stated, written comments to the Board's General Counsel, or at the public hearing on July 10, 2009, will not be considered. Any comments and supplemental information received after 5:00 p.m. July 13, 2009, will not be considered.

The hearing will be conducted in a manner that allows all members of the public to speak. Please note that time limits on public comments may be imposed.
