EPA Awards ARRA CWSRF Grant

The United States Environmental Protection Agency (EPA) announced today that they have awarded the Texas Water Development Board (TWDB) over $179 million from the American Recovery and Reinvestment Act (ARRA) of 2009 for projects to be funded through the Clean Water State Revolving Fund (CWSRF).

TWDB approved the ARRA CWSRF Intended Use Plan at the Board meeting held on June 18, 2009.  Invitations to submit applications for funding have been administered to all eligible applicants.

DRAFT ARRA CWSRF IUP - Includes Project Priority List with Drawn Funding Line
Based on the allocation of funds to categories illustrated on Page 6 of the draft ARRA CWSRF IUP, a funding line has been drawn on Appendix C. Project Priority List.  Please note, after considering public comment the funding line may change in the final ARRA CWSRF IUP.  The final funding line may be adjusted thereafter as the TWDB proceeds with reviewing applications.  See page 10 of the ARRA CWSRF IUP.

TWDB May Board Meeting

Public Hearing Notice for
Clean Water State Revolving Fund Intended Use Plan for
American Recovery and Reinvestment Act of 2009


The Texas Water Development Board (“Board”) will conduct a public hearing on the draft American Recovery and Reinvestment Act of 2009 (“ARRA”) Clean Water State Revolving Fund (“CWSRF”) Intended Use Plan (“IUP”) to implement funding under the ARRA special CWSRF capitalization grant. The hearing will begin at 1:30 PM on Friday, June 12, 2009, in Room 170 of the Stephen F. Austin Building at 1700 N. Congress Ave., Austin, Texas 78701. Public access to the Stephen F. Austin Building is located at the Congress Avenue (east) entrance of the building.


The ARRA CWSRF IUP contains a list of wastewater projects in prioritized order which will be considered for funding through the CWSRF loan program. The draft ARRA CWSRF IUP has been prepared pursuant to rules adopted by the Board in 31 Texas Administrative Code Chapter 375. Please note that these rules have been waived or modified by the TWDB in certain respects in order to comply with special requirements for the ARRA CWSRF capitalization grant. The ARRA CWSRF funds must be used to fund projects that are either under construction or fully committed to construction contracts no later than February 17, 2010. Accordingly, the projects are prioritized on the basis of readiness to proceed to construction before that date. ARRA also requires that 20% of the available funds are set aside for “green” projects and 50% for deep subsidization of projects which the Board has reserved for disadvantaged communities. Interested persons are encouraged to attend the hearing and to present relevant and material comments concerning the draft ARRA CWSRF IUP. The Board also will receive information from applicants in addition to that previously provided in order to supplement or clarify a project’s readiness to proceed, disadvantaged community status, or qualifications as a “green” project. However, the Board will not consider any changes or modifications to the scope of work for any project. In addition, persons may submit written comments to General Counsel, Texas Water Development Board, P.O. Box 13231, Austin, Texas 78711, or may file comments at rulescomments@twdb.texas.gov. Comments and supplemental information provided outside of electronic submission at the address stated, written comments to the Board’s General Counsel, or at the public hearing on June 12, 2009, will not be considered. Any comments and supplemental information received after 5:00 p.m. June 15, 2009, will not be considered. Interested persons also may review the draft ARRA of 2009 CWSRF IUP at the Board’s website at: http://www.twdb.texas.gov/stimulus/documents/draft_ARRA_CWIUP.pdf. Copies of the draft ARRA CWSRF IUP also may be obtained in Room 560 on the 5th floor of the Stephen F. Austin Building or may be obtained from the Texas Water Development Board, Project Finance, P.O. Box 13231, Austin, Texas 78711.


The hearing will be conducted in a manner that allows all members of the public to speak. Please note that time limits on public comments may be imposed.
